Terms of Service

1. Who you are contracting with

Turnmarks is operated by Brainware Analytics GmbH, Rathausstrasse 14, 6340 Baar, Switzerland, registered in the Swiss commercial register under CHE-114.517.014 (“we”, “us”). Contact: support@turnmarks.com.

These terms govern your use of turnmarks.com and the Turnmarks application (the “Service”). By creating an account you accept them. Payment is taken by a separate company — see section 5.

2. What the Service is

The Service draws turn markers on hourly charts of 13 instruments and, on the paid plan, sends a message to Telegram when one appears. A marker is the output of a fixed rule applied to price data, the same rule for every subscriber; what it is looking for is described on the how it works page.

The Service also shows historical statistics describing what price did after past markers. Those are descriptions of history. They are not a backtest, they contain no entry, exit, spread or position sizing, and they are not a prediction.

3. What the Service is not

Turnmarks is not investment advice. We are not a bank, not a securities dealer, not an asset manager and not a financial adviser, and we are not authorised or supervised as any of those by FINMA or any other regulator.

Nothing in the Service is a recommendation, solicitation or offer to buy or sell anything. We do not know your circumstances, your capital or your risk tolerance, and we make no judgement about whether any instrument is suitable for you.

Every trading decision you make is yours alone. Trading foreign exchange, commodities and cryptocurrency carries a high risk of loss, including the loss of everything you put in. Past behaviour of price does not predict future behaviour. If you need advice, consult someone licensed to give it.

4. Your account

5. Plans, payment and cancellation

The free plan shows every marker on every instrument, delayed by up to 24 hours. It costs nothing and needs no card.

The paid plan is USD 14.99 per month. It removes the delay and adds Telegram alerts. It renews automatically each month until you cancel.

Payment is processed by Whop Inc. as merchant of record. That means Whop, not us, is the seller for the payment itself: they charge your card, they handle applicable taxes, and their terms govern the transaction. We never see or store your card details.

You can cancel at any time from your account page, which opens Whop's billing page. Cancelling stops the next renewal and leaves your access running until the end of the period you have already paid for. See the refund page for the rest.

6. Availability, data and changes

We work to keep the Service running and current, but we do not promise uninterrupted availability. Price data comes from a third-party broker feed and may be delayed, incomplete or wrong; markers computed from bad data will be wrong too. Maintenance, outages, feed failures and market closures all mean no new markers.

We may change the rule, the instruments, the plans or the price. Material changes that affect the paid plan will be announced by email to the address on your account before they take effect, and you are free to cancel.

8. Intellectual property

The Service, its content, its interface and the marker rule remain ours. Your subscription buys access for the period you pay for; it does not transfer any ownership or grant a licence beyond your own use.

9. Limitation of liability

To the maximum extent Swiss law allows, we are not liable for trading losses, lost profit, lost opportunity, or any indirect or consequential loss arising from your use of the Service, from a marker being late, absent, wrong or based on faulty data, or from the Service being unavailable.

Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the event. Nothing here excludes liability for intentional misconduct or gross negligence, which Swiss law does not permit us to exclude.

10. Termination

You may stop using the Service and delete your account at any time. We may terminate for a material breach of these terms, or with 30 days' notice to your account email for any other reason — in which case any period you have paid for and not used is refunded.

11. Changes to these terms

We may update these terms. The date at the top always says when. If a change materially reduces what you get on a paid plan, we will email the address on your account before it applies.

12. Governing law

Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Baar, Canton of Zug, Switzerland. If you are a consumer resident in the EU or EEA, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
